1. Agreement to These Terms
These Terms of Service ("Terms") are a legal agreement between you and Homeloom ("Homeloom," "we," "us," or "our"). By accessing or using Homeloom, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Homeloom.
2. The Homeloom Service
Homeloom helps families privately preserve memories, stories, traditions, milestones, photos, videos, comments, and related family content. Some features may be labeled as coming soon, beta, preview, or early access. Features may change as we learn from families and improve the service.
3. Eligibility and Accounts
You must be old enough to form a binding agreement in your location or use Homeloom with the involvement and consent of a parent or legal guardian. You are responsible for your account, password, devices, and all activity under your account. Keep your account information accurate and notify us promptly if you believe your account has been compromised.
4. Family Spaces and Invitations
Family spaces are intended for private family and trusted-circle sharing. A family organizer or authorized member may invite others, manage permissions, remove members, or change access settings. You are responsible for inviting only people you trust and for understanding that invited members may view, comment on, save, or otherwise interact with content available to them.
5. Your Content
You retain ownership of photos, videos, stories, comments, reactions, names, dates, milestones, and other content you upload or create in Homeloom ("User Content"). By adding User Content to Homeloom, you grant us a limited, non-exclusive, worldwide license to host, store, reproduce, display, transmit, back up, and process that content solely to operate, protect, improve, and provide the service as described in these Terms and our Privacy Policy.
You represent that you have the rights and permissions needed to upload and share User Content, including content that includes other people, children, family members, copyrighted material, or personal information.
6. Privacy
Our Privacy Policy explains how we collect, use, share, retain, and delete information. By using Homeloom, you acknowledge that your information will be handled as described in the Privacy Policy.
7. Acceptable Use
You agree not to misuse Homeloom or help anyone else do so. You may not upload, share, or use Homeloom to create content or activity that is unlawful, harmful, abusive, exploitative, defamatory, invasive of privacy, infringing, fraudulent, sexually exploitative, hateful, threatening, or otherwise objectionable. You may not attempt to access accounts or systems without permission, interfere with security features, scrape the service, send spam, or use Homeloom in a way that could harm families, children, users, Homeloom, or third parties.
8. Child Safety
Homeloom has zero tolerance for child sexual abuse material, exploitation, grooming, trafficking, or any conduct that harms children. We may remove content, suspend accounts, preserve evidence, report to appropriate authorities, and cooperate with lawful investigations when we identify suspected child-safety violations. Parents and guardians are responsible for supervising children's use of Homeloom and managing child-related content shared in family spaces.
9. Reporting and Enforcement
If you believe content or behavior violates these Terms, contact us at safety@homeloomfamily.com. We may review, remove, restrict, or preserve content; limit features; suspend or terminate accounts; or take other action when we believe it is necessary to protect users, families, Homeloom, or others.
10. Paid Features
Homeloom may offer paid subscriptions or purchases in the future. If paid features are offered, pricing, renewal, cancellation, refund, and billing terms will be provided at the time of purchase and may also be governed by Apple, Google, or another payment provider. You are responsible for any taxes, fees, and charges associated with your purchase.
11. App Store Terms
If you download Homeloom through the Apple App Store, Google Play, or another app marketplace, your use may also be subject to that marketplace's terms, policies, and billing rules. Those marketplace providers are not responsible for Homeloom except as required by their own terms or applicable law.
12. Optional Assistant Tools
Homeloom may offer optional storytelling, planning, and photo guidance tools. These tools are provided for convenience and inspiration. You remain responsible for reviewing any suggestions, deciding what to save or share, and ensuring that your content is accurate, respectful, lawful, and appropriate for your family.
13. Homeloom Intellectual Property
Homeloom, including its name, logo, design, software, text, graphics, interfaces, and other materials, is owned by Homeloom or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use Homeloom's branding or proprietary materials except as needed to use the service.
14. Feedback
If you send us ideas, suggestions, or feedback, you allow us to use them without restriction or compensation. We appreciate feedback, but please do not send confidential information through feedback channels.
15. Service Changes and Availability
We may add, change, suspend, or discontinue features at any time. We aim to provide a reliable and thoughtful service, but Homeloom may be unavailable from time to time for maintenance, updates, security, outages, or reasons outside our control.
16. Disclaimers
Homeloom is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and reliability. We do not guarantee that family content will never be lost, interrupted, delayed, corrupted, or accessed without authorization, although we use reasonable measures to protect the service.
17. Limitation of Liability
To the fullest extent permitted by law, Homeloom and its officers, employees, contractors, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities. Our total liability for any claim relating to Homeloom will not exceed the amount you paid to Homeloom for the service in the twelve months before the claim, or one hundred U.S. dollars if you paid nothing, unless applicable law requires otherwise.
18. Indemnification
You agree to defend, indemnify, and hold harmless Homeloom from claims, damages, liabilities, losses, and expenses arising from your User Content, your misuse of the service, your violation of these Terms, or your violation of another person's rights.
19. Termination
You may stop using Homeloom at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk or legal exposure, or used the service in a harmful way. Sections that by their nature should survive termination will continue to apply, including ownership, licenses needed to complete existing service obligations, disclaimers, limitations of liability, indemnity, and dispute terms.
20. Governing Law
These Terms are governed by the laws applicable in the United States and, where relevant, the state laws of the jurisdiction in which Homeloom is organized, without regard to conflict-of-law rules. Some locations provide consumer rights that cannot be waived; nothing in these Terms limits those rights.
21. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the service, by email, or by another appropriate method. Your continued use of Homeloom after updated Terms become effective means you accept the updated Terms.
